Department of Licensing (DOL) Hearing

Along with criminal penalties associated with a DUI charge, there are also administrative penalties that you face which are separate from the criminal matter.  This is arguably the most frustrating aspect of the DUI process, making the experience both stressful and unpleasant for you and your loved ones.

When you are arrested for Driving Under the Influence, the officer should give you a Department of Licensing (DOL) Hearing Request Form. This form gives you an opportunity to request a hearing to challenge the suspension of your license. It is important to note that you MUST request this administrative hearing to challenge the actions that will be taken against you by the department. If you fail to request this hearing within 30 days from the time of the incident, then the DOL will automatically take action and suspend your driver's license.

The DOL hearing is usually done over the phone between you and your attorney and the DOL hearing examiner. The hearing will be held within 60 days of your arrest for this charge. You have the option to represent yourself in this matter, but that action is not recommended. The examiner who administers this hearing is usually an attorney who is trained to fight these battles.
